General Terms and Conditions of Use – TMA eCardio

These General Terms and Conditions of Use (the “Terms”) govern access to and use of the TMA eCardio mobile application (the “Application”), owned by TELEMATIC MEDICAL APPLICATIONS LTD (“TMA”), a Greek company registered in the General Commercial Registry (No. 007904401000), Tax Identification Number 998889850, with registered office at 151 Al. Papanastasiou Ave., Piraeus, Attica, 18533, Greece, phone +30 211 1165330-2, email [email protected].

User” means any individual who accesses, navigates, installs, registers for, or uses the Application.

1. Acceptance of the Terms

Before using the Application, each User must read and explicitly accept these Terms. Access or use of the Application constitutes full, explicit, and unconditional acceptance of the Terms.
Use of the Application is restricted to individuals of legal age with full legal capacity. If you do not agree with these Terms, you must refrain from installing or using the Application.

2. Services and Functionality of TMA eCardio

Scope of the Application. TMA eCardio is designed to work exclusively with the Mintti Heartbook device via Bluetooth. It enables Users to:

  • Pair and connect with the Mintti Heartbook device,
  • Record ECG measurements,
  • View ECG results in graphical form,
  • Access and manage measurement history,
  • Optionally export/share reports where available.

Not Supported. The Application does not support:

  • AI-based measurements,

  • Manual entry of measurements,

  • Integration with any medical devices other than Mintti Heartbook.

Intended Use. TMA eCardio is intended to facilitate ECG measurement capture and review for personal health monitoring and, where applicable, to support communication with a healthcare professional outside the Application. The Application does not provide medical diagnoses or treatment and is not a substitute for professional medical advice. In case of a medical emergency, call 112 (or your local emergency number) immediately.

Availability of Features. Certain features may require registration, network connectivity, firmware/software updates, or an active subscription plan. TMA may add, change, or remove features at its discretion (see Section 9).

3. Data Collection

Personal data processed through the Application is described in the TMA eCardio Privacy Policy. Data is collected and stored exclusively for the purposes outlined therein.

Users are responsible for the accuracy and completeness of all information provided or generated through their use of the Application and acknowledge that incomplete or inaccurate information may affect service quality or data interpretation.

4. User Obligations

Users agree to:

  • Provide truthful, accurate, and up-to-date information,
  • Use the Application only for lawful purposes and in accordance with these Terms,
  • Respect third-party rights, including intellectual and industrial property and privacy/image rights,
  • Refrain from introducing content that is false, defamatory, harmful, offensive, or unlawful,
  • Not interfere with, damage, reverse engineer, disrupt, overload, or otherwise impair the Application, its infrastructure, or security,
  • Not copy, modify, adapt, translate, reproduce, distribute, or create derivative works from the Application or its content without prior written consent from TMA,
  • Promptly notify TMA of any malfunction so corrective actions can be taken.

TMA may deny or withdraw access to Users who violate these Terms, without prior notice, and such Users shall be liable for resulting damages.

5. Subscriptions, Billing, and In-App Purchases

Certain features may be offered under subscription plans or in-app purchases (“Paid Services”).

  • Billing & Provider. Payments are processed by the applicable app store (e.g., Google Play). Your billing relationship is governed by the app store’s terms and refund policies.
  • Renewals & Cancellation. Subscriptions may auto-renew unless canceled in the app store settings before the renewal date.
  • Changes. TMA may modify pricing or features of Paid Services prospectively. Any change will be communicated via the app store or within the Application, and will take effect on the next billing cycle.

6. TMA’s Responsibility and Disclaimers

TMA strives to ensure the proper functioning and continuity of the Application and to safeguard User data according to the Privacy Policy. However:

  • TMA is not responsible for medical decisions, interpretations, or outcomes based on data viewed in the Application.
  • TMA is not liable for damages arising from inaccuracies or omissions attributable to the User, device misuse, or third-party dependencies (including Bluetooth connectivity, mobile OS, or network issues).
  • TMA is not liable for interruptions, errors, malware, malfunctions, or disconnections affecting the Application, the User’s device, or medical equipment due to causes beyond TMA’s control (including internet congestion, third-party services, or force majeure).
  • TMA does not control how Users utilize TMA eCardio and assumes no responsibility for such use.

Upon exiting the Application, TMA’s terms and policies no longer apply to third-party environments.

7. Technical Specifications for Optimal Functioning

For best results when using TMA eCardio with the Mintti Heartbook device:

  • Keep both devices sufficiently charged (recommendation: >30% battery).
  • Ensure Bluetooth is enabled and the Mintti Heartbook is in pairing/measurement mode.Minimize interference from nearby wireless/Bluetooth devices and keep phone and device within close range.
  • Keep the mobile device’s OS, the Application, and the device firmware up to date.
  • Reduce heavy background processes during pairing/recording and avoid power-saving modes that limit Bluetooth performance.

8. Operating System Requirements

Access to the Application requires:

  • Android devices running Android 12 or later (or as otherwise specified in the store listing).

9. Intellectual Property

The Application and all content therein (including texts, graphics, UI design, images, audio/video elements, logos, trademarks, and software) are protected by intellectual property laws and are owned by TMA or licensed to TMA.

TMA retains all rights to reproduction, distribution, public communication, and transformation. Any use beyond what is expressly permitted by these Terms or applicable law requires TMA’s prior written consent.

Users may only make private, personal use of the Application. Commercial or unlawful use is strictly prohibited. Creating links that replicate or frame the Application without prior written consent from TMA is prohibited.

10. Modification

TMA may modify these Terms, the Application’s design, presentation, configuration, or services at any time. Updates will be made available within the Application and/or via an online link. Continued use of the Application after such updates constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by Greek law. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of Athens, Greece.
